Nanogirl Labs, (NGL) Party Booking Terms and Conditions

1. COVID-19

To give you confidence in booking, rest assured that if you need to change your booking as a result of the New Zealand Government’s COVID response level system, we will provide a full refund and/or waive the usual rescheduling fee, depending on whether you choose to cancel or reschedule. This overrides our usual cancellation/change policies set out below.

2. Health and Safety

Nanogirl Labs’ top priority is the health and safety of their staff and customers. Your presenter—and everyone supporting them behind the scenes—will follow strict safety procedures and risk management protocols, developed by our specialist team, in presenting your party. These events are designed to be absolutely safe for young participants—if you would like to review the specifics of these protocols, please let us know in advance of your party and a representative will walk you through it.
Our staff are trained and experienced in managing groups of children. However, it is very important to note that all children present at the party remain the responsibility of the parents / supervising adults at the party. The following minimum supervision levels must be met for the safety of all involved:
1. Only participants within the stated age range for the party may take part in the event, unless otherwise agreed in writing prior to the event.
2. There must be two responsible adults who remain on-site for the duration of each party in addition to the Nanogirl Party Presenter.
3. Nanogirl Labs require a minimum ratio of 1:12—1 responsible adult to every 12 children (aged 3 and above) present—including those in (i) above.
4. If younger family members are attending the event, there must be one adult present for every two children under the age of 3 in attendance, in addition to the supervision levels above.
You agree to take all practicable steps to provide a safe and healthy environment for the party, suitable for the attendees and the activities planned.
If, while on site at the party, the Presenter considers that it is unsafe to present the party or any part thereof, they may at their sole discretion terminate the event and make safe, or alter the content of the party to achieve a safe result. This will not be considered as a failure to deliver by Nanogirl Labs, and no refund shall be payable. We request your full support and cooperation in ensuring the safety of all involved in the event.
In paying your deposit, you acknowledge the nature and extent of the potential hazards and risks of children participating in science experiments that may arise, and agree to assume those risks and to release, discharge, indemnify and hold harmless NGL and its administrators, directors, agents, contractors and employees, for any and all claims demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of NGL.

3. Payment

A Nanogirl Birthday Party deposit of $100 NZD is payable to secure your booking. By paying this deposit you are accepting all Nanogirl Labs Party Booking Terms and Conditions.
The remainder of the fee owing is payable on invoice no later than 7 days before the party. Please note that if you fail to pay the balance on time, we reserve the right to cancel your booking, which will result in the forfeiture of your deposit.

4. Cancellations and Refunds

You can cancel your booking at any time. The more notice we have of a cancellation, the easier it is for us to adapt our schedule—and the less time our team will have spent preparing your special day for you. Depending on how near to the date of the party you advise us of the cancellation, you may forfeit some or all of the fees you have paid, as follows:
1. In the event of a cancellation, other than as set out below, we will refund all fees paid in full. Please note though that:
2. If you cancel less than 20 business days before the party, we will withhold a $30 administration fee from the amount refunded.
3. If you cancel between 10 and 3 business days before the party, you will forfeit your $100 deposit. Any other applicable fees paid (if you have already paid the balance owing for instance) will be refunded to you in full.
4. Cancellation within 3 business days of the party will result in forfeiture of the full booking amount.
Please note that these terms relate only to party delivery fees. Any items of merchandise purchased as part of your booking, or as a separate order, are subject to our standard merchandise terms and conditions.
Cancellations should be advised in writing, by email, to party@nanogirllabs.com.
For clarity, cancellations will be treated as being received on the first business day after the date received by our systems.
In the unlikely event that Nanogirl Labs becomes unable to deliver your party, we will make every effort to contact you as soon as practicable after we become aware of the circumstances. In this instance, you will—at your discretion—have the option to cancel the party and receive a full refund, or to reschedule the party with the change fee (See 5 below) waived.

5. Changing your Booking

If you wish to transfer your Party Booking to a different date and/or time, you will be required to pay a $30.00 transfer charge at the time of making the change. Nanogirl Labs will endeavor to work with you to find a suitable alternative date and time for both parties. In the event that this is not possible then you will have deemed to have canceled the booking at that time (see (4) above). There will not be a charge if a date change is caused by NGL, for any reason.
Other changes to your booking—adding additional participants, or additional services—incur no change fees. We will always endeavour to meet your requirements, but cannot guarantee to accommodate any changes made within 5 business days of the party.
Nanogirl Labs reserves the right to change the content of any Party Booking, including, but not limited to, the experiments incorporated within the party programme, the allocated party presenter etc.

6. Travelling to and from the Party

Your Party Fee includes travel from your closest Centre (cities and towns where we have presenters and equipment ready to go) to a party venue anywhere within 30km of that Centre one way.
We calculate distances using the most direct route on Google Maps from the centre to your venue address. Our Centres are defined by their pin locations on Google Maps (e.g. ‘Auckland’ is defined as being The Sky Tower).
Travel over 30km each way will be billed to you at the current Inland Revenue mileage claim rate ($0.79/km as at September 2020).
On receiving your booking, our team will assess the travel distances (using Google Maps— Directions from [Centre] to your address), and – if any additional fees are payable—will contact you with a firm quotation. You may cancel your booking within 7 days of that notification without penalty, regardless of the terms in (4) above.
Worked example: a party in Whangarei. The closest Nanogirl Centre is Auckland. Google Maps shows the shortest distance between Auckland CBD and Whangarei as 160km one way. 160km, less the 30km one-way travel allowance built into the party fee, is 130km. 130km @ $0.79 = $102 each way, or a total of $204 in additional travel fees payable.

7. Content (includes a note on allergens)

The Slime party uses gluten free marshmallows and cornstarch and the slime we make uses PVA glue and borax solution. Our presenters are all highly trained, and aware of the ingredients in their experiments. As the party purchaser, however, you are entirely responsible for ensuring that all guests and their caregivers are adequately informed and that any allergy is reported to the Party Presenter prior to the beginning of the party. The more notice you give us, the more likely we are to be able to adjust the party to accommodate!

8. Photography and Social Media

Nanogirl Labs values the safety of young people—and the privacy of our customers’ homes— greatly. Nanogirl Labs staff will not take photographs at your party without your express permission in advance. If Nanogirl Labs do seek permission, please do not hesitate to place such limits or restrictions on those images as you see fit.
There will be an opportunity for party participants to take photographs during the party event. Posting these images on social media in such a way that ‘tags’ one of Nanogirl Labs’ social media accounts will be taken as giving permission for us to on-share the image.
